How do I know if I am Cybersquatting?

What is cybersquatting and really how do you know if you are cybersquatting if you are to purchase a domain? The Anticybersquating Consumers Protection Act ( ACPA ) provides against registering or using an internet domain name or any other identifier of an online location that is:

- The TM of a company or person or entity other than the person registering the domain name or using the identifier
- Sufficiently is similar to a TM of a person or entity other than the person or entity registering or using the identifier as to be likely to

  • cause the public confusion or a mistake
  • deceive or
  • cause dilution of the distinctive attributes and quality of the TM that is registered

We need to keep in mind that the ACPA is only one acting act out of numerous State and Federal Laws that prevent various actions with the respect to the registration and use of a domain name in conjunction with the US Federal Trademark law.

So you need to consider before you make a investment in a domain name to be used a thorough search with the Federal US Trademark office should be conducted to make sure that your not potentially asking for trouble.

    Well that all depends. If you are cyber squatting then try and monetize that squat until you are called out and legally forced to hand it over.

    I believe that it all comes down to being in the right place at the right time, honesty and integrity.

    Eventually what comes around goes around.

    Lots of websites “cause the public confusion or a mistake” and/or “deceive” - are they cybersquatters, too?
